1. Who we are. Harpier is operated by Harpier LLC, a New York limited liability company. ("Harpier," "we," "us," "our"). You can reach us at hello@harpier.com or 418 Broadway, Albany NY 12207. Harpier is a community story activation platform. We help institutions capture stories from their community, curate them, and connect people who are making a decision with people who have already made it.
2. What these terms cover. These Terms of Service ("Terms") govern your use of harpier.com, stories.harpier.com, and any other website, page, or form we operate that links to these Terms (together, the "Site"), along with any Harpier tools or experiences you access as an individual. If your institution has signed a separate written agreement with Harpier, that agreement governs the services delivered to that institution. Where the two conflict, the signed agreement controls for that institution and its authorized users. These Terms still apply to your personal use of the Site. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
3. Who can use Harpier. You must be at least 13 years old to use the Site or participate in a Harpier experience. We do not knowingly collect information from anyone under 13, and we do not permit participation by anyone under 13. If you are between 13 and 17, you may only participate where your institution has arranged participation for your age group and where the required parental or guardian permission has been obtained. Participation for this age group is opt-in, and information collected is held separately under additional restrictions described in our Privacy Policy. If you are using the Site on behalf of an institution, you confirm you have authority to bind that institution to these Terms.
4. Acceptable use. You agree not to:
Use the Site for any unlawful purpose, or in violation of any applicable law or regulationImpersonate another person, or misrepresent your affiliation with any institution
Attempt to access accounts, data, or systems you are not authorized to access
Scrape, harvest, or systematically extract content or personal information from the Site
Interfere with, disrupt, probe, or overload the Site or its infrastructure
Upload malicious code, or use the Site to transmit spam or unsolicited communications
Post content that is defamatory, harassing, hateful, deceptive, or that infringes someone else's rights
Use the Site or its content to train a machine learning model without our written permission
We may suspend or terminate access to anyone who violates these Terms, at our discretion and without notice.
5. Stories, Captures, and participation. Harpier's core service involves capturing stories and experiences from members of a community, and connecting community members with each other.
If you share a story or take part in a Capture. You keep ownership of what you share. By submitting it, you grant Harpier and the institution you are associated with a non-exclusive, worldwide, royalty-free license to store, process, curate, excerpt, and use your submission for the purposes described at the point of collection and in the applicable consent or release you signed. The scope of that consent controls. If your consent limits use to a particular purpose, channel, or time period, that limit governs.
If your story is used publicly. We rely on the specific consent you gave. You may withdraw consent for future use at any time by contacting hello@harpier.com. Withdrawal does not undo uses already made, and it may not be able to reach material already distributed by third parties or embedded in printed or archived material. We will act on a withdrawal request without undue delay.
If you take part in a connection or conversation. These are real conversations between real people. Storytellers speak for themselves, not for Harpier or for their institution. We do not verify or endorse the accuracy of anything a participant says. Do not treat a conversation as official guidance from an institution on admission, financial aid, immigration, academic standing, employment, or any other matter. Always confirm important information with the institution directly.
Conduct in connections. Treat other participants with respect. Do not record a conversation without the other person's knowledge and agreement, do not share another participant's contact details or personal information outside the experience, and do not use a connection to sell, recruit, or solicit for anything unrelated.
6. Automated and AI-assisted processing Harpier uses automated tools, including third party large language model services, to help organize, summarize, and curate the stories and information we collect. Before information is sent to those tools, we replace names and direct identifiers with coded IDs. Our providers are engaged under commercial terms that prohibit using your content to train their models. Automated tools assist our work. They do not make decisions about admission, enrollment, financial aid, employment, or any other outcome that materially affects you. Institutions make those decisions.
7. Our intellectual property The Site, the Harpier name and logos, the Gathering Engine, the Capture, Curate, Connect methodology, and all software, design, text, graphics, and other content we provide are owned by Harpier or our licensors and are protected by intellectual property law. We grant you a limited, revocable, non-transferable license to view and use the Site for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of it without our written permission.
8. Third party services and links The Site links to and relies on third party services, including our scheduling provider, our website host, and our email and analytics providers. When you follow a link or use one of these services, that provider's terms and privacy practices apply. We are not responsible for third party services or the content of external sites.
9. Disclaimers The Site and any free tools or content we make available are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.We do not warrant that the Site will be uninterrupted, secure, or error free, or that any content is accurate, complete, or current. Nothing on the Site is legal, financial, immigration, medical, or professional advice. Outcomes described on the Site, including results from past engagements, are specific to those engagements and are not a promise or prediction of results for anyone else. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability To the maximum extent permitted by law, Harpier and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the Site, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the Site is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars ($100). Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
11. Indemnification You agree to defend, indemnify, and hold harmless Harpier and its officers, employees, contractors, and agents from any claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising from your use of the Site, your content, or your violation of these Terms or of any law or third party right.
12. Changes to the Site and to these Terms We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we will change the "Last updated" date above and, for material changes, provide a more prominent notice. Continuing to use the Site after a change means you accept the updated Terms.
13. Governing law and disputes These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Albany County, NY, and you consent to the jurisdiction of those courts. If you are in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings locally, nothing here removes that right.
14. Miscellaneous If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and Cookie Policy and any signed agreement between us, are the entire agreement between you and Harpier regarding the Site.
